This page constitutes an agreement between the User and DSS which governs the access and use of DSS website. Please read this Terms of Use carefully and make the appropriate choices before accessing and/or using DSS website. Definitions

·       DSS means PT Dian Swastatika Sentosa Tbk, a publicly listed company, which owns and operates DSS website to provide information about DSS and its subsidiaries.

·        DSS website means this website, an online based service that facilitates the User to obtain information about DSS and its subsidiaries.

·        User means every party who accesses and/or uses DSS website.

 
No Warranties and Representation

DSS does not make any representation or give any warranty (whether express or implied) as to the completeness or accuracy of any information or any other information provided or contained in DSS website. The User should independently and duly verify such information before the User acts upon it. If the User choose to rely upon any material on DSS website, or its availability, the User assumes the total risk and responsibility for such reliance.

Privacy Statement

User acknowledges to have read and agree to the DSS’ Privacy Statement and consent to DSS’ collection, use and disclosure of User’s personal data for the purposes as set out in the Privacy Statement.

Limitation of Liability

DSS puts efforts to keep DSS website secure, convenient, and functional. Data and information in DSS website, however, might not be available in real time. DSS website may become unavailable due to maintenance or malfunction of computer equipment or other reasons and may be altered, suspended, or discontinued at any time for any reason without prior notice. The User agrees to use DSS website based on the User’s own risks, and that DSS website is available as it is. To the extent permitted by applicable laws, DSS (includings its subsidiaries, management, and employees) is not liable, and the User agrees not to hold DSS responsible for any damages or losses (including but not limited to the losses of money, reputation, profit, or other material or immaterial losses) arising directly or indirectly from:

·         negligence and/or loss incurred by the User in relation to the access or use, or inability to access or use DSS website

·         virus or any other dangerous software obtained by accessing or connecting to DSS website

·         interruption, bugs, delays, or any errors in DSS website

·         any hacking actions done by third party to the User’s account or DSS website

·         damage to the User’s hardware because of the use of DSS website

·         other matters related to the use of DSS website

Modifications

DSS reserves the right to change any part of DSS website at any time at its absolute and sole discretion without prior notice. Changes may be made to any material from time to time.

Indemnity

The User hereby agrees to indemnify and/or compensate DSS (including its affiliates, subsidiaries, management, and employees) from any claims or charges for damages and losses (actual and implied) arising from User’s violation of the prevailing laws and regulations and/or any provisions of this Terms of Use, including but not limited to legal fees, administrative fines, and rights protection costs. Therefore, the User agrees to release any legal protection (stipulated in applicable rules and regulations) that will limit the scope of this indemnity.

DSS failure to exercise or any delay in exercising its rights under this Terms of Use does not constitute a waiver of these rights, and the sole or partial exercise of any of its rights under this Terms of Use does not hinder the exercise of any other rights. DSS has the right to require User to continue to perform their obligations and bear the corresponding liability for breach of contract at any time.

DSS’ Intellectual Property

The intellectual property in and to the DSS website and materials are owned, licensed to or controlled by DSS, DSS’ licensors or service providers. DSS reserves the right to enforce the right of the intellectual property to the fullest extent of the law.

No part or parts of the DSS website may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcast, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means or stored in an information retrieval system or installed on any server, system or equipment without DSS’ prior written permission.

Applicable Law and Jurisdiction

DSS makes no representation that information on DSS website is appropriate or available for use outside of the Republic of Indonesia. Any claims relating to, and the use of DSS website and the materials contained herein is governed by the laws of the Republic of Indonesia with the Courts of Indonesia having exclusive jurisdiction.

All queries and/or requests related to DSS website may be made through Contact Us menu. By writing message on the Contact Us menu, the User agrees to receive emails, short messages, or notifications from DSS in relation to the message that has been submitted.

This Terms of Use shall constitute the entire agreement between User and DSS relating to the subject matter hereof and supersedes and replaces in full all prior understandings, communications and agreements with respect to the subject matter hereof.
